PURCHASE AGREEMENT
This is a contract for the sale of a  pet quality purebred AKC Miniature Schnauzer.  This document concerns a live animal and is executed with prejudice in favor of that  animal's well being by the undersigned.  This is a contract only and  shall not be used for, nor construed to be an application for registration of  that animal.
This agreement is between Tracy Bearden  (breeder/seller) and
_____________________________(buyer) for one puppy (  )  Male or (  ) Female on this day of _______________.
The buyer is subject to all terms and conditions set  forth below as follows:

    The buyer agrees to assume full responsibility  for the dog once it leaves the sellers premises.  The buyer further  agrees to
provide a warm and safe environment in their home, provide fresh food and water daily and  have annual veterinarian visits  for the up keep and care of said dog .  The  buyer agrees to take the puppy to the veterinarian of their choice at 
their own expense within 72 hours (96 if shipped) after acquiring the puppy from  the breeder.  If satisfied with the
veterinarian's report, to retain  possession and thereafter hold the breeder blameless and NOT liable for  any further medical condition of said animal.  IF NOT SATISFIED the animal is to  be returned to the breeder at the buyer's expense within two (2) days  of the examination.  The buyer also agrees that in the event of the  animal's death within those 72 or 96 hours, the puppy will be taken to a  veterinarian for a necropsy. If death is proven to be due to a genetic  illness within (2) years
of it's birth date, the dog will be replaced with another pup of equal value. See Below for more information.  
IT IS FURTHER UNDERSTOOD THAT ANY  COSMETIC SURGERIES SUCH AS EAR TRIMS WILL BE AT
THE BUYER'S RISK AS  THAT IS NOT NECESSARY FOR THE DOG TO LIVE A FULL AND HEALTHY  LIFE.
     The breeder has taken every  reasonable precaution to ensure the physical soundness
and temperament of the animal, including that its sire and dam have no known hereditary  defects.
The breeder does not guarantee any health related issues or loss  of life due to reactions caused by vaccinations or
flea and tick  preparations administered either orally or on the skin.  The breeder recommends that vaccines be given no
closer than 4 weeks  apart.  It is further recommended that Rabies Vaccine NOT be given at  the same time as
any other vaccine.Breeder will not replace or refund for any reason but not limited to allergy 
mortality; landlord’s disapproval; disagreement of family; or any other reason not related to health.  Nor for a puppy’s illness caused by neglect; exposure to weather; injury; choking; poisoning; etc....No warranty or guarantee is made to the disposition; life-span; size; color; show quality; or breeding quality of any puppy.  No guarantee is made regarding the puppy’s bite.  Should a licensed veterinarian diagnose the puppy with a life threatening genetic defect having been there from birth; the Breeder will replace the puppy, limited to two years from the date of purchase.  Breeder will not be liable for any expenses including but not limited to any veterinary bills or other expenses. No replacement will at any time be made on a deceased puppy until a necropsy is performed to determine the cause of death.  Necropsy must be performed by an accredited institution set up for such procedures or a licensed veterinarian approved by the Breeder.  Necropsies performed by a local veterinarian or one not approved by Breeder will not be accepted.  All expenses pertaining to the necropsy will be paid by the owner of the pup.  The necropsy results will accompany any request for replacement of refund.  Retained testicles and hernias are excluded from this guarantee.   As a dog breeder, animal health is my top priority.  That’s why NuVet Plus immune system builder is required as part of your pet’s Health Guarantee .  
The buyer must contact the Breeder immediately upon discovery of a life threatening genetic defect.  Any delay in doing so, voids this guarantee.  
The Breeder also has the right to have the puppy examined by her veterinarian. This guarantee is null and void upon any
evidence of abuse or neglect, or if the buyer fails to maintain necessary scheduled puppy check ups with a qualified veterinarian.  Proof of said maintenance must be furnished upon request of Breeder. 
 No guarantee is given for any kind of worm, coccidiosis, or giardia.  Your puppy and its dam have been regularly wormed while in my possession.  It is your responsibility to continue to worm your puppy and check for parasites.  No guarantee is given for hypoglycemia (low blood sugar).  This condition is not hereditary and is preventable.
      Buyer and Seller agree that this  puppy is being sold as a PET ONLY all registration papers will be
marked LIMITED unless stated here. -----------------------------------------------------. If buying a pet puppy, by signing this agreement you are also agreeing to have said pet spayed or neutered.  Any offspring from this dog will never be able to be registered with any registry. If for some reason the registration papers are not available at the time the buyer takes possession of the puppy, they will be sent to the buyer as soon as they are received. 
  
     The BUYER hereby agrees that if at any time the BUYER cannot take proper care of said puppy, the BUYER must contact the BREEDER and the BREEDER will have first choice of either a) take said puppy back or b) assist the BUYER in finding a suitable home for the said puppy.  The BUYER also agrees to notify the BREEDER of any changes of address during the puppy's lifetime.
  
PURCHASE
INFORMATION
In consideration of the purchase  price of  $_____________plus shipping__________.  A deposit of 50% of the  purchase price  shall be paid in advance and the balance of  $________to be paid by cash, cashier's check or money order before the puppy leaves the breeder.  The balance plus applicable shipping  must be paid at least 7 days prior to shipping.
NOTE: IF  YOU ARE USING PAYPAL TO PAY ANY PORTION OF THE PURCHASE PRICE OF THE  PUP, YOU MUST ADD 4% TO THE PAYPAL PORTION. 
  DEPOSITS ARE NON-REFUNDABLE AND NON-TRANSFERABLE.  
In most cases puppies are ready to  leave for their new home at 8 weeks of age, however it is at the sole discretion of the breeder.  Once the puppy is released buyer must take  possession within 7 days, failing which the buyer agrees
to pay  boarding charges of $5.00 per day.
THE BREEDER HAS THE RIGHT TO CANCEL  THIS CONTRACT AND REFUND THE DEPOSIT IF SHE
FEELS IT IS IN THE BEST  INTEREST OF THE PUPPY.
This is a binding contract.  By  signing this contract and returning it to the breeder with the deposit, the  buyer agrees that they have read and fully understand all of the terms  and conditions  Any amendments to this contract must be in writing and  signed by all parties, oral representations are not binding.  Buyer agrees that any legal proceedings will take place in Orange CountyFlorida.
